Reputation Report Card Terms and Conditions

These Terms and Conditions (Terms) are between the individual requesting the online reputation evaluation services (you; your) and the Gen Digital entity (Gen) based on your location specified at the end of these Terms (we; our). These Terms apply to our provision of our online reputation report card (Reputation Report Card) which you can utilize to determine whether to contract for our ReputationDefender Offerings (RD Offerings). By requesting the provision of the Reputation Report Card, you agree to all of the following.

1. Right to Use.  We will provide you with the Reputation Report Card free of charge so that you can evaluate the potential reputational impact of content that appears in the Google search results for the Named Party (defined below). You must use the Reputation Report Card for evaluation purposes only and in no event can you sell or license the results of the Reputation Report Card to any third party. You shall follow all our instructions related to the use of the Reputation Report Card. As part of the Reputation Report Card, you will receive a link to view a report. You agree that we may refer to this report when discussing a potential agreement with you for the RD Offerings.
2. Acquiring Reputation Report Card for a Named Party.  You must be the individual or entity, or an authorized representative of the individual or entity, for whom the Reputation Report Card will be performed (Named Party). Where the Named Party is a minor, you must be the parent or legal guardian of the minor for whom the Reputation Report Card is requested. References in these Terms to performing the Reputation Report Card for you shall also be a reference to performing the Reputation Report Card for the Named Party’s benefit as the context requires.
3. Intellectual Property Rights.  Gen or its licensors own all intellectual property in the Reputation Report Card. You may not remove or modify any references to copyright or other intellectual property rights in the reports generated as part of the Reputation Report Card.
4. Privacy. The Reputation Report Card is provided subject to our privacy policy located at www.reputationdefender.com/legal/privacy-policy (Privacy Policy). You confirm that you have received all applicable third party consents (including any Named Party) to our processing of any personal data provided by you in connection with the provision of the Reputation Report Card.
5. Warranty.  The Reputation Report Card is provided “as-is” and without warranty of any kind.
6. Limitation of Liability.  We shall accept no liability for your use of the Reputation Report Card as described in these Terms.
7. Duration.  These Terms apply to your generation of the Reputation Report Card and to your ongoing use of it.
8. Confidentiality.  Each party acknowledges it may receive information that is confidential and proprietary to the other in the course of providing the Reputation Report Card. Each party agrees not to use such information except in the performance of these Terms and not to disclose such information to third parties.
9. Governing Law.  If you are based in EMEA: The laws of Ireland. Venue for any legal action will be the Irish courts, Dublin; If you are based in Japan: The laws of Japan. Venue for any legal action will be the Japanese courts; If you are based in the Asia Pacific region: The laws of Singapore. Venue for any legal action will be the courts of Singapore. If you are based in the Americas: The laws of California. Venue for any legal action will be the courts of Santa Clara County, California. The English language version of these Terms will prevail in the event of any translations. You waive any right to have these Terms officially written in the language of the applicable country where you are located where applicable.
10. Entire Agreement.  These Terms are the entire agreement and understanding between the parties relating to the Reputation Report Card.
